David Rivkin seems to miss the point. He says the UN is stretching the anti-torture laws to the inmates at Guantanamo simply being held is ignoring the rules of war: mainly if you capture an enemy you have the right to hold them until the war is over. However he misses the point that holding them under the "Enemy Combantant" monicur allows the Bush administration to completely ignore the Geneva Convention when dealing with these individuals. (Actually he ignores this point, and pretends like it is the same as POW status).Either charge them, treat them like they should be treated (like POW's) or let them go.
